Terms and conditions of Quotation and Sales

These are the terms and conditions of quotation and sale of all services supplied by Karen Batten, except as otherwise agreed to in writing. Most importantly, Karen Batten may use any Artwork/design for promotion and portfolio on the createtogether website. Karen will use an industry standard ‘designed by’ link to the client’s website, enhancing client Search Engine Optimisation. Karen Batten’s ‘designed by’ link will remain for the life of the design except by negotiation. If a design is not appropriate for Karen’s promotion please make that known.

General
1.    Quotations are valid for 6 months.
2.    If a client cancels or alters any part of the brief at any time after work has begun, additional costs or payment of work to date will be incurred.

Terms of Payment
3.    For quotations $1000 and over the client shall make payment within the following terms:
a.    20% deposit on receipt of quotation approval;
b.    40% on design sign-off of website or print work;
c.    40% balance upon either of the following:

  1. if a website, when site is posted live or;
  2. if print work, for first job together before finished work being handed to the client and/or forwarded to the nominated printer or if print work, for regular clients after finished work being handed to the client.
  3. if workshops, when delivery of last workshop and debrief has been completed.
  4. if the work has exceeded 6 months.

d.    All payments are to be made in full within 7 days of the date of invoice.
4.    For quotations under $1000 the client shall make payment within the following terms:
a.    Unless otherwise negotiated, on first job together in full on receipt of approved quotation;
c.    Unless otherwise negotiated, for regular clients in full on receipt;

  1. if a website, after site is posted live or;
  2. if print work, after finished work being handed to the client.
  3. if workshops, when delivery of last workshop, feedback and debrief has been completed.
  4. if the work has exceeded 6 months.

d.    All payments are to be made in full within 7 days of the date of invoice.
5.    Payment shall be made by either electronic deposit, cash, cheque.
Copyright and Ownership
6.    All ideas, designs, concepts, artwork, compositions, symbols or logos prepared or developed by Karen Batten shall be the property of the client after final payment is received. A charge to burn DVD of artwork will apply.
7.    Karen Batten may use any Artwork/design for promotion and portfolio use and add an industry standard ‘designed by’ link to the client’s website, enhancing client Search Engine Optimisation. Karen Batten’s ‘designed by’ link will remain for the life of the design except by negotiation. If a design is not appropriate for Karen’s promotion please make that known.

Revisions and Supply of Content
8.    Unless otherwise negotiated, the client must supply text for their project in text file format at the start of the project as well as graphics (logos, images, etc.) to be used. Text should be as close as reasonably possible to final format, with accuracy of content, spelling and grammar checked and little or no formatting (includes text from previous websites). Karen Batten assumes that all text is owned and generated by the clients unless referenced.
9.    Images are also expected to be supplied before work begins, unless by prior negotiation or if using Karen Batten’s group image creation, photography or stock image services. Images should be supplied in the highest resolution electronic format possible, i.e. logos/images in original Illustrator/Photoshop format, or hi-res JPEG files (300 dpi). Karen Batten assumes that all correct permissions have been sought and/or royalties paid for images used.
10.    Unless otherwise quoted or negotiated, projects over $1000 include two rounds of changes or author’s revisions. Following two revisions per project, an additional hourly fee will be charged. For projects under $1000 one round of changes are included and an additional hourly fee will be charged. Karen Batten will advise you and seek your agreement before proceeding with any work that will incur additional charges.

Project Duration and Client Response Time
11.    The client agrees to provide timely responses to Karen Batten after receiving status notifications, work for review or requests for information. The client shall have 60 days to respond to each draft/request for information submitted. If the client has failed to respond after 60 days, Karen Batten will deem the on hold. At such time, Karen Batten the client shall pay all fees and expenses associated with the work performed. Unless otherwise negotiated, Karen Batten will happily work on the project again within 6 month or the negotiated time.
